Walmart has settled a class-action lawsuit that accused the US retail giant of overcharging for certain food items. Without accepting liability, Walmart has agreed to put aside $45m to resolve the legal action. The case, “Kukorinis v Walmart Inc.”, alleged Walmart falsely inflated the weight of certain grocery items, mislabeled the weight of bagged produce, and overcharged for sold-by-weight clearance products, forcing customers to pay more than the lowest advertised price.
The plaintiff claimed Walmart’s point-of-sale machines would artificially raise the weight of discounted “Rollback” items, causing customers to pay more than the advertised discount. Additionally, Walmart was accused of promoting bagged produce weights greater than the actual weight, leading to customers paying more per ounce.
Walmart has consistently denied these allegations. In response to reaching the settlement, Walmart stated, “We will continue providing our customers everyday low prices to help them save money on the products they want and need. We still deny the allegations, however we believe a settlement is in the best interest of both parties.”
Eligible customers who purchased certain weighted goods at Walmart locations in the US and Puerto Rico between October 19, 2018, and January 19, 2024, have until June 5 to submit a claim. Individual claims are capped at $500, and a final settlement approval hearing is scheduled for June 12.
