The implementation of new sanctions includes the following measures:

  • Firstly, persistent offenders found holding illicit tobacco products may face a penalty of up to £10,000.
  • Secondly, any seized tobacco products may be potentially destroyed.
  • Lastly, economic operator ID track and trace codes may be temporarily or permanently deactivated for businesses consistently violating the rules. This restriction or removal of their ability to purchase or sell tobacco in the UK serves as a deterrent.

To help businesses adhere to the UK tobacco track and trace rules, HMRC has prepared comprehensive guidance on the new penalties. You can find this guidance by visiting the official government website.

James Lowman, the chief executive of ACS, expressed his approval of the track and trace system, highlighting its importance in monitoring legitimate products throughout the supply chain. He further emphasized the significance of the newly implemented measures aimed at combating the illicit tobacco market.

Lowman states, “The illicit tobacco trade poses severe risks and is detrimental to responsible retailers and our local communities. Therefore, it is imperative that these new sanctions are supported by effective local enforcement measures. Only by removing illicit products from the shelves and deterring criminal activity can we safeguard the integrity of the industry.”

If you require further information on selling tobacco and related regulations, ACS’ Assured Advice guide is readily accessible on their website here.
