Müller’s acquisition of Yew Tree Dairy, a UK-based dairy business, is currently under scrutiny by the country’s competition authority.

The Competition and Markets Authority (CMA) have announced the initiation of a merger inquiry to assess whether the transaction could lead to “a substantial lessening of competition.” The deadline for the first phase decision is set for October 22, while the period for interested parties to comment on the transaction will close on September 10.

This deal, which was announced in June, highlighted Müller’s intent to utilize Yew Tree’s milk powder to expand its export operations and enhance supply-chain resilience. Yew Tree Dairy, established in 1904 and located in Skelmersdale, Lancashire, specializes in producing fresh milk and cream. Moreover, after substantial investment in recent years, the company has expanded its production capabilities to include milk powder.

Upon completion of the deal, Müller plans to significantly invest in increasing the capacity and capabilities of the milk drying facility in Skelmersdale. This move is expected to improve its milk drying capabilities, positioning it as a major producer and exporter of powdered milk products made in Britain.

In the UK, Müller, part of the Germany-based Unternehmensgruppe Theo Müller, manufactures and markets both branded and private-label dairy products, along with a dedicated range of plant-based products. Last November, Müller made the strategic decision to divest its UK milk delivery service, Milk & More, to Freshways, a local dairy group.

The CMA has recently granted provisional approval for T&L Sugars’ proposed acquisition of Tereos’ UK assets, although this transaction underwent a “Phase 2” investigation due to potential competition concerns raised during the initial inquiry. Conversely, the CMA dismissed a legal challenge from French bakery group Cérélia regarding its attempt to acquire dough business Jus-Rol, following a protracted negotiation period.
